General Conditions of Sale
ARTICLE 1 / OBJECT
The company LA FERME DES HISTOIRES MÉLANGÉES, known as the ‘Host’, mainly offers the seasonal rental of cabins and guest rooms, as well as the sale of packed lunches. The purpose of these General Terms and Conditions of Booking, Rental and Sale is to define the rights and obligations of the parties in connection with the rental of seasonal accommodation and related services via the www.lafermedeshistoiresmelangees.com website.
Any booking made on the www.lafermedeshistoiresmelangees.com website implies acceptance of these General Terms and Conditions of Rental, which the customer acknowledges having read, understood and accepted with full knowledge of the facts.
LA FERME DES HISTOIRES MÉLANGÉES reserves the right to modify these General Terms and Conditions of Rental at any time, without prior notice, given that such modifications will be inapplicable to bookings - rental requests previously accepted and confirmed by the customer.
ARTICLE 2 / GENERAL PROVISIONS
These general terms and conditions of sale may be consulted on the company's website at the following address: www.lafermedeshistoiresmelangees.com
LA FERME DES HISTOIRES MÉLANGÉES ensures that acceptance of the general terms and conditions of sale is clear and unreserved by putting in place a tick box and a validation click.
LA FERME DES HISTOIRES MÉLANGÉES reserves the right to modify these terms and conditions of sale at any time by publishing a new version on its website. The general terms and conditions of sale applicable will be those in force on the date of payment of the booking by the Customer.
LA FERME DES HISTOIRES MÉLANGÉES undertakes to provide the necessary advice and information to the Customer so that the latter can ensure that the offer meets his/her needs.
The Customer, referred to as the ‘Hirer’, declares that he/she is of legal age and of full capacity. They also declare that they have the legal capacity to contract legally under French law and that they hold a valid personal bank card. Bookings (services and goods) for minors must be made by a parent or legal guardian.
ARTICLE 3 / PRICE
All bookings, whether made directly or via gift vouchers, are personal and may not be transferred to a third party. Bookings are validated once we have given our agreement and received a deposit of at least 25% of the total cost of the stay, payable by credit card (via our website), cheque, cash or bank transfer.
For bookings made via our online booking system with secure payment www.lafermedeshistoiresmelangees.com, a 50% deposit will be debited from your credit card at the time of booking.
For bookings made by telephone or e-mail via our booking service, a deposit of 50% of the total cost of the holiday must be paid by cheque, holiday vouchers or bank transfer at the time of booking. In this case, the booking is blocked for 15 days. Receipt of payment within this period will validate the booking. Please note: your booking option may be withdrawn if payment is late, as the option period is 15 days.
The price of your stay is given in €uros inclusive of all taxes. The tourist tax* will be added to your final bill.
No price reduction will be granted in the event of late arrival or early departure by the customer. The balance must be paid the day before or the day of departure. An invoice will be issued at the end of the stay, including tourist tax* (per person per night) and any supplements (packed lunches, drinks). Any damage or disappearance will also be billed separately.
ARTICLE 4 / REGULATIONS
The hirer has several means of payment for the deposit and the rental:

Bank transfer: please ask us.

Bank or postal check, payable to ‘SAS LA FERME DES HISTOIRES MELANGEES’ (French accounts only).

Holiday vouchers (by paying the host directly on site).

Credit card: Mastercard and Visa via our website, paypal.

Cash: You must withdraw the necessary amount from a cash dispenser.
This deposit is valid for 12 months from the date of collection.
The balance at the end of your stay must be paid by bank or postal cheque, holiday vouchers or cash.
ARTICLE 5 / WITHDRAWAL PERIOD
For bookings made by post, telephone or internet, the Hirer does not benefit from the withdrawal period, in accordance with article L121-21-8 of the French Consumer Code relating in particular to the provision of accommodation services supplied on a specific date or at a specific time.
ARTICLE 6 / CANCELLATION & POSTPONEMENT
In the event of cancellation or postponement by the tenant: Any cancellation or postponement must be notified to the owner by registered letter.
a) in case of force majeure :
In the event of serious illness, serious accident or death of a registered occupant, the stay will be refunded in full on presentation of medical evidence or a death certificate.
In the event of serious illness, serious accident or death of a member of the family not staying in the Cabin, the stay will be postponed free of charge within 12 months of cancellation, on medical proof or death certificate only. No refund can be requested.
b) cancellation before arrival :
The deposit remains the property of the owner. The owner may request the balance of the cost of the stay if the cancellation is made less than 30 days before the planned date of arrival.
If the tenant does not show up within 24 hours of the arrival date indicated on the contract, the present contract becomes null and void and the owner may dispose of the cottage. The deposit also remains the property of the owner, who will request payment of the balance of the rental.
c) postponement before arrival :
The deposit is valid only for a stay to be made within the 12 months following payment of the deposit. The tenant may postpone their stay at the Ferme des Histoires Mélangées only once. After that, the tenant will not be entitled to any stay with the owner and the deposit will be retained by the owner as compensation.
The owner may ask for the balance of the cost of the stay if the postponement occurs less than 30 days before the planned date of arrival.
d) if the stay is shortened : the rental price remains the property of the owner. No refund will be made.
e) if the host cancels the stay : The host reserves the right to cancel the stay at the last minute due to bad weather or strong winds. In other cases, the host will pay the tenant all the sums paid, as well as compensation at least equal to that which the tenant would have had to pay if the cancellation had been his fault on that date.
ARTICLE 7 / PURCHASING AND BOOKING WITH A GIFT VOUCHER
Gift vouchers are not subject to the 14-day cooling-off period provided for by the Hamon law.
a) Validity of gift vouchers : Gift vouchers are valid for 12 months from the date of purchase. They can be used any day that La Ferme des Histoires Mélangées is open.
b) Cancellation before your stay :
In the event of serious illness, serious accident or death of an occupant or family member not staying in the Cabin, the stay will be postponed free of charge within 12 months of cancellation, on presentation of medical or death certificate only. No refund can be requested.
For any stay cancelled that does not fall within the above-mentioned cancellation clauses, the full amount of the stay booked will be due or will be retained by La Ferme des Histoires Mélangées.
c) Changes before your stay : The same conditions apply as for a classic booking, while respecting the validity date of your gift voucher (see 7.a).

ARTICLE 8 / ARRIVAL AND DEPARTURE
Our cabins and guest rooms do not all have the same arrival and departure times. We welcome you between 3pm and 6pm. The tenant undertakes to inform LA FERME DES HISTOIRES MÉLANGÉES of any late arrival. After 8pm, if the tenant has not shown up and has not informed LA FERME DES HISTOIRES MÉLANGÉES of this delay, the host reserves the right to re-let the room or cabin and to keep the booking deposit. Departure is by 12 noon at the latest, depending on the cabin.
ARTICLE 9 / USE OF THE PREMISES
The tenant undertakes to respect the peaceful nature of LA FERME DES HISTOIRES MÉLANGÉES and to preserve the peace and quiet of the other residents. They must return the room or cabin in perfect condition at the end of their stay and undertake to declare and pay for any damage for which they may be responsible. Smoking is strictly prohibited in all the cabins and in the guest room at LA FERME DES HISTOIRES MÉLANGÉES. A private, free, unguarded car park is available to each guest at each cabin and close to the chambre d'hôte. LA FERME DES HISTOIRES MÉLANGÉES cannot be held responsible for theft or damage to vehicles.
ARTICLE 10 / CAPACITY
This contract is drawn up for a maximum capacity of persons. If the number of guests exceeds the capacity, the host may refuse to accept additional guests. Any modification or breach of the contract will be considered to be at the tenant's initiative.
ARTICLE 11 / BREAKFAST, PACKED LUNCH
Breakfast is left outside the room between 9am and 10am.
For guests sleeping in the cabins: breakfast is delivered directly to the cabin terrace between 9am and 10am.
Guests wishing to order a ‘Candlelight Dinner’ must book at least 24 hours in advance with the hosts and have prior confirmation from LA FERME DES HISTOIRES MÉLANGÉES. Dinner is served from 7pm in the room, on the terrace or directly in the cabin. No meals are served on Sunday evenings.
If you would like a packed lunch on the day of your arrival, please let us know when you make your booking or by calling us.
ARTICLE 12 / HOUSEKEEPING
Cleaning is done on departure, except for stays of more than 2 nights, when we will offer to freshen up the room. Bed linen is changed regularly, and towels can be changed daily on request. Out of respect for the environment, our guests may choose to keep the same bathroom linen for a stay not exceeding 3 days.
ARTICLE 13 / PETS WELCOME
Dogs are only allowed in the cabins at LA FERME DES HISTOIRES MÉLANGÉES on condition that they do not climb on the beds, sofas and armchairs. Hair and paw prints must be cleaned up by yourself when you leave.
We reserve the right to charge a supplement of 50 euros if these conditions are not met.
Dogs are not allowed in our guest room The Nest.
It is strictly forbidden to leave your pets alone in the cabins while you are away.
ARTICLE 14 / INSURANCE & LIABILITY
The tenant of the establishment LA FERME DES HISTOIRES MÉLANGÉES must be covered by civil liability insurance. LA FERME DES HISTOIRES MÉLANGÉES may not be held liable in the event of loss, theft or damage to personal belongings on the entire estate, whether inside or outside the facilities. If a tenant causes personal injury or damage to property, his civil liability may be sought for compensation.
ARTICLE 15 / PRIVACY POLICY
In France, personal data is protected in particular by law no. 78-87 of 6 January 1978, law no. 2004-801 of 6 August 2004, law no. 2016-1321 of 7 October 2016 for a Digital Republic, article L. 226-13 of the Criminal Code and European Regulation (EU) 2016/679 on personal data of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) JOUE L127 2 of 23/05/2018
The information you are asked to provide on the website is required to process your request and make your booking. It is used for the following purposes: tracking bookings, generating statistics, email and telephone communications.

You have the right to lodge a complaint with the CNIL concerning the processing of your data.
ARTICLE 16 / DISPUTES
In the event of payment being rejected, the Tenant shall bear the bank charges invoiced to LA FERME DES HISTOIRES MÉLANGÉES relating to this rejection.
Any complaint relating to the state of the premises and/or the state of the description of the place of stay must be sent by registered letter with acknowledgement of receipt within 30 days of the stay to the following address: LA FERME DES HISTOIRES MÉLANGÉES , Le Bourg, 19 430 Sexcles.
Any other complaint must be sent by letter as soon as possible.
In the event of a dispute, the courts of Brive-La-Gaillarde shall have sole jurisdiction.
